(1) If a person arrested in accordance with this Act is found guilty of a forest-related case punishable by imprisonment for one year or more, or if there is reasonable grounds to appear guilty from such evidence, such accused shall be detained and prosecuted.
(2) Offenders other than those mentioned in sub-section (1) shall be liable to imprisonment or a fine of up to the maximum amount of cash bail or bail on the given date, and in case of failure to do so, the case shall be kept in custody. But the guilty party cannot be released on bail.
(3) When the accused is detained and prosecuted under sub-section (1) or (2), the days spent in detention shall be counted as imprisonment and the offender shall not be detained for more than the limit of punishment.
